Homestead Exemptions in Montana

Updated: Jul 30, 2023

The state of Montana has something called a Homestead Exemption which protects the investment you have made in your primary home.

So what is it?

A homestead declaration is a legal document designed to protect up to $350,000 of value in your home against most creditor’s claims in times of financial hardship.

What qualifies as a homestead?

A property qualifies as a homestead if it is located in the state of Montana and consists of a dwelling serving as your primary residence.

Why file for an exemption?

Life is unpredictable and you should always consider protecting the equity in your property.

For minimal financial cost – just notarization and recording fees – the homestead exemption could be your saving grace in the event you are ever in financial distress.

How can you apply?

For a declaration of homestead in Ravalli County, you can obtain the form from the Ravalli County website. You need to fill out the form with your info and have the document notarized. Once complete, you file the document with the Ravalli County Clerk & Recorder’s Office.

Boom! $350,000 of your investment is protected (once recorded with the county).
